Renewals - Griffith Hack

Intellectual Property Offices in most countries, including Australia, raise revenue by charging periodic fees to keep patents, registered trade marks and registered designs in force.

Australia



For standard patents, the term is 20 years from the date of filing of the complete specification. Renewal fees are charged annually by the Australian Patent Office and fall due from the fifth anniversary of the filing date in Australia. For a PCT application the Australian filing date is the same as the international filing date. Fees range from a few hundred dollars initially, and increase progressively up to year 19. For innovation patents, fees fall due on the second anniversary of the filing date in Australia and increase progressively up to year 7. Griffith Hack's contract service provider CPA Global handles fee payment on behalf of clients.

Overseas



Renewal fees are usually charged annually, and usually fall due on the anniversary of the application date. In some countries fees are payable whilst an application is pending, as well as after a patent is granted. Fees are typically a few hundred dollars, and increase progressively over the life of the patent. The notable exception is the United States, where fees are charged at four year intervals after grant.
