Patent Prosecution/Examination
Patent Prosecution/Examination - Griffith Hack
| Each country has different processes for examining applications. In some countries examination is automatic. In others it must be requested. If objections are raised, each country gives the applicant at least one chance to respond. If objections cannot be overcome, the application will eventually be refused. Patent Offices allow patent applications once all objections have been overcome. In some countries competitors have the right to oppose after acceptance or after grant. Once a patent has been granted, it is able to be enforced. However it is usually necessary to apply to a court to enforce the patent. |
