The Delhi Patent Office has recently rejected Boehringer Ingelheim’s product patent application for a paediatric form of the anti-aids drug nevirapane.  Boehringer’s patent was held non-patentable under s3(d) of the Indian Patents Act 1970.  That subsection was introduced in an attempt to prevent the “evergreening” of chemical patents and has particular relevance to the pharmaceutical industry.
