In our May 2011 report ‘.XXX Reservations’, we informed you that the Registry for the top level domain .xxx (ICM Registry) will offer a unique rights protection mechanism to those that do not wish their trade marks to be associated with the XXX Community, by allowing rights holders to reserve domain names that correspond with their trade marks during a pre-launch period called “Sunrise B”. Domain names reserved in this way will be blocked from live use. ICM Registry has published the rules for defensive registrations. The Sunrise B period will commence on 7 September 2011 and run until 28 October 2011.
Each applicant will need to demonstrate its eligibility to the trade mark, by providing proof of ownership or, where the applicant is licensed or assigned the mark, completion of a standard declaration form signed by both the applicant and the licensor/assignor. Applications will involve a one-off fee with no renewal fees.
