28 May 2012 is the date set for the commencement of the national system to register business names. However this commencement date is still subject to the passage of legislation through State and Territory parliaments.

What you need to know

  • In the meantime , if you have a business name registration which is due to expire before the new ASIC business name register commences, we suggest renewing the business name and paying the fee to the state or territory in question.
  • Where you have an identical business name registered in multiple States/Territories, all business names will transfer to the ASIC business names register on commencement. You may choose to keep one business name registration (for example, the business name with the latest registration expiry date) and cancel the registration of your other remaining business names. This should be undertaken after commencement of the system.
  • Keeping only one business name will reduce the administrative burden of maintaining several business name registrations, and minimise confusion in determining the business name holder’s correct details.
