Italy implements patent box regime to support IP commercialisation

January 16, 2015

Italy is the latest in a growing list of nations to introduce preferential tax treatment for intellectual property (IP) in the form of a ‘patent box’ incentive. The Italian patent box is available from 1 January 2015, and will effectively reduce tax on income attributable to Italian IP by 30% in 2015, 40% in 2016 and 50% from 2017 onward.

Enhanced scope for patent term extension

January 14, 2015

Extension of patent term (PTE) is available in Australia for up to 5 years for patents relating to pharmaceutical substances provided that the patent discloses and claims:

(a) a pharmaceutical substance per se; or

(b) a pharmaceutical substance when produced by a process that involves the use of recombinant DNA (rDNA) technology.

While a number of cases address the first class of patents, to date there has been, at best, only passing comment in relation to the second class.
