Coke loses battle over iconic Contour bottle

On 28 November 2014, the Federal Court of Australia dismissed claims made by The Coca-Cola Company (TCCC) against PepsiCo Inc, PepsiCo Australia Holdings Pty Ltd and Schweppes Australia Pty Ltd (collectively referred to as the respondents) for infringement of trade marks held by TCCC and for engaging in passing off and misleading and deceptive conduct under section 52 of the the Trade Practices Act 1974 (now section 18 of the Australian Consumer Law).

Registration of trade marks containing foreign words

The High Court of Australia today upheld an appeal in Cantarella Bros Pty Limited v Modena Trading Pty Limited, deciding that the words “oro” and “cinque stella” were “inherently adapted to distinguish” Cantarella’s coffee products in Australia. This decision clarifies the relevant principles of trade mark law that are applicable and their interpretation in determining the ability of particular word marks to be registered.

A grant program for investors and those seeking to commercialise intellectual property

As one of Australia’s leading Intellectual Property firms, Griffith Hack is constantly seeking opportunities for our clients to gain maximum value from their investment in innovation. One opportunity that is available, yet commonly overlooked, is the Export Market Development Grant (EMDG) program.

The EMDG program is a broad based Federal Government grant, that reimburses applicants up to 50% of eligible expenses (with a maximum grant of $150,000), provided applicants have incurred at least $15,000 of eligible expenses in a given grant year. First time applicants are able to combine two years of expenses to meet this threshold.
